What was changed
Sri Lanka's financial crisis brought inflation, blackouts, and shortages of imported medical supplies. People used Facebook to solicit medicines, but Meta's rules generally prohibited drug solicitation. In April 2022, the company chose to leave one such post online under its little-known “spirit of the policy” allowance.
Meta's Global Operations team had conducted a risk assessment as protests and the medical crisis intensified. Human-rights, safety, and regional teams could be consulted, and the exception was extended to similar requests in Sri Lanka and to posts outside the country in Sinhala. The allowance lasted seven months, until November 2022, but did not extend the same way to Tamil-language posts outside the country.
On March 9, 2023, Meta's Oversight Board upheld the decision as consistent with the company's human-rights obligations. It also said secret, discretionary exemptions were incompatible with those responsibilities and recommended public criteria, user notice, a transparency-center register, and aggregate data. The immediate crisis decision worked; the governance system around future exceptions was still unfinished.
What it achieved
Medicine requests stayed online during the crisis, and the Oversight Board upheld the decision; the exception covered similar Sinhala-language posts for seven months.
Why it worked
A rigid no-solicitation rule could have removed requests for scarce medicines while the country was struggling to import essential supplies.
The Global Operations risk assessment surfaced a direct conflict between written rules and the local emergency.
A bounded, market- and language-specific exception gave Meta a way to respond without rewriting its global community guidelines.
External review by the Oversight Board supplied legitimacy while exposing the need for transparent controls.
What can be applied
When a global rule causes harm in a local emergency, a narrowly bounded exception can preserve the mission—but publish criteria, scope, notice, and audit data before discretion becomes a blank check.
Aftermath
The case established a defensible local-context precedent for Meta, but not a completed policy reform. The Oversight Board's recommendations made the next decision explicit: explain when the exception applies, tell users when it is used, and publish enough data for outsiders to test whether a crisis allowance remains narrow.
